REGISTERING A FOREIGN CORPORATION
Guam is
open for business to Companies from other
states and even foreign countries.
However, a Foreign corporation, limited
partnership or LLCs, may not transact
business on Guam until it
A company wishing to bid on Gov Guam
Procurement Contracts will usually need to
accomplish these tasks before submitting its
bid. A bid by an unlicensed company will
often be disqualified.
Further, a foreign corporation or entity
authorized to transact business on Guam must
continuously maintain on Guam a registered
office and agent.
Generally, all construction contractors (and
subcontractors) doing business on Guam are
required to be licensed with the Guam
Contractors License Board, but do not need a
regular business licenses. This applies to
both local and off-island construction
companies.
An exception to this general rule is
permitted in the case of a foreign or an
off-island contractor doing work exclusively
on US military installations. These
companies do not need a Contractor's
License, but must still obtain a general
business license.
All foreign or off-island corporations,
Limited Liability Companies, etc. engaged in
construction, whether on military
installations or not, are still required to
register their company and obtain a
certificate of authority.
